TOWN CLERK, DENISE PETTEYS INFORMED THE BOARD THAT THE CREDIT CARD COMPANY, BB&T HAS ADVISED THAT THEY WILL NOT BE CHARGING THE TOWN THE CREDIT/DEBIT CARD CANCELLATION FEE OF $195.  SHE WILL BE CONTACTING JOEL CARPENTER TO SEE HOW HE WOULD LIKE ANY MONEY LEFT OVER IN THE ACCOUNT RETURNED TO HIM SO THAT THE ACCOUNT CAN BE CLOSED OUT.

ADOPT LOCAL LAW NO. 1 OF 2015 AUTHORIZING THE USE OF THE BEST VALUE PROCUREMENT STANDARD

RESOLVED THAT THE FOLLOWING LOCAL LAW BE APPROVED:
BE IT ENACTED BY THE TOWN BOARD OF THE TOWN OF HARTFORD:
SECTION 1.        AUTHORITY.                                    
THIS LOCAL LAW IS ADOPTED PURSUANT TO THE AUTHORITY VESTED IN THE TOWN BOARD OF THE TOWN OF HARTFORD PURSUANT MUNICIPAL HOME RULE LAW SECTION 10 OF THE STATE OF NEW YORK AND GENERAL MUNICIPAL LAW SECTION 103 OF THE STATE OF NEW YORK.
SECTION 2.        PURPOSE.
NEW YORK GENERAL MUNICIPAL LAW SECTION 103 REQUIRES COMPETITIVE BIDDING FOR PURCHASE CONTRACTS AND SERVICE CONTRACTS AND HAS REQUIRED THAT SUCH BIDS BE AWARDED TO THE LOWEST RESPONSIBLE BIDDER WHO BID MEETS THE REQUIREMENT OF THE SPECIFICATIONS FOR THE PARTICULAR PROJECT.  GENERAL MUNICIPAL LAW SECTION 103 WAS AMENDED BY CHAPTER 608 OF THE LAWS OF 2011 AND CHAPTER 2 OF THE LAWS OF 2012 TO AUTHORIZE THE TOWN TO AWARD PURCHASE CONTRACTS AND CONTRACTS FOR SERVICES SUBJECT TO COMPETITIVE BIDDING ON THE BASIS OF EITHER THE LOWEST RESPONSIBLE BIDDER OR “BEST VALUE” AS DEFINED IN SECTION 163 OF THE NEW YORK STATE FINANCE LAW.  THE TOWN BOARD HEREBY DETERMINES THAT IT IS IN THE BEST INTEREST OF THE TOWN OF HARTFORD FOR THE TOWN BOARD TO HAVE THE AUTHORITY TO AWARD PURCHASE CONTRACTS AND CONTRACTS FOR SERVICES ON THE BASIS OF BEST VALUE.
SECTION 3.        APPLICABILITY.
THE PROVISIONS OF THIS LOCAL LAW APPLY TO TOWN PURCHASE CONTRACTS, INCLUDING CONTRACTS FOR SERVICES, INVOLVING AN EXPENDITURE OF MORE THAN $20,000, BUT

EXCLUDING PURCHASE CONTRACTS NECESSARY FOR THE COMPLETION OF A PUBLIC WORKS CONTRACT PURSUANT TO ARTICLE 8 OF THE NEW YORK LABOR LAW AND ANY OTHER CONTRACT THAT MAY IN THE FUTURE BE EXCLUDED UNDER STATE LAW FROM THE BEST VALUE OPTION.  IF THE DOLLAR THRESHOLDS AS SET FORTH IN NEW YORK GENERAL MUNICIPAL LAW SECTION 103 ARE INCREASED OR DECREASED IN THE FUTURE BY THE STATE LEGISLATURE, THE DOLLAR THRESHOLDS SET FORTH HEREIN SHALL BE DEEMED SIMULTANEOUSLY AMENDED TO MATCH THE NEW GENERAL MUNICIPAL LAW THRESHOLDS.
SECTION 4.        STANDARDS FOR BEST VALUE.
GOODS AND SERVICES PROCURED AND AWARDED ON THE BASIS OF BEST VALUE ARE THOSE THAT THE TOWN BOARD DETERMINES WILL BE OF THE HIGHEST QUALITY WHILE BEING THE MOST COST EFFICIENT.  THE DETERMINATION OF QUALITY AND COST EFFICIENCY SHALL BE BASED ON OBJECTIVELY QUANTIFIED AND CLEARLY DESCRIBED AND DOCUMENTED CRITERIA, WHICH MAY INCLUDE, BUT SHALL NOT BE LIMITED TO, ANY OR ALL OF THE FOLLOWING:  COST OF MAINTENANCE PROXIMITY TO THE END USER IF DISTANCE OR RESPONSE TIME IS A SIGNIFICANT TERM; DURABILITY; AVAILABILITY OF REPLACEMENT PARTS OR MAINTENANCE CONTRACTORS; AND LONGER PRODUCT LIFE; PRODUCT PERFORMANCE CRITERIA; AND QUALITY OF CRAFTSMANSHIP.
SECTION 5.        DOCUMENTATION.
WHENEVER ANY CONTRACT IS AWARDED ON THE BEST VALUE INSTEAD OF LOWEST RESPONSIBLE BIDDER, THE BASIS FOR DETERMINING BEST VALUE SHALL BE THOROUGHLY AND ACCURATELY DOCUMENTED.
SECTION 6.        PROCUREMENT POLICY.
ANY INCONSISTENT PROVISION OF THE TOWN’S PROCUREMENT POLICY, AS ADOPTED PRIOR TO THE EFFECTIVE DATE OF THIS LOCAL LAW BY RESOLUTION OF THE TOWN BOARD, OR AS AMENDED THEREAFTER, SHALL BE DEEMED SUPERCEDED BY THE PROVISIONS OF THIS LOCAL LAW.
SECTION 7.        SEVERABILITY.
IF ANY CLAUSE, SENTENCE, PARAGRAPH, SUBDIVISION, SECTION, OR PART OF THIS LAW OR THE APPLICATION THEREOF TO ANY PERSON, INDIVIDUAL, CORPORATION, FIRM, PARTNERSHIP, ENTITY, OR CIRCUMSTANCE SHALL BE ADJUDGED BY ANY COURT OF COMPETENT JURISDICTION TO BE INVALID OR UNCONSTITUTIONAL, SUCH ORDER OR JUDGMENT SHALL NOT AFFECT, IMPAIR OR INVALIDATE THE REMAINDER THEREOF, BUT SHALL BE CONFINED IN ITS OPERATION TO THE CLAUSE, SENTENCE, PARAGRAPH, SUBDIVISION, SECTION, OR PART OF THIS LAW, OR IN ITS APPLICATION TO THE PERSON, INDIVIDUAL, CORPORATION, FIRM, PARTNERSHIP, ENTITY, OR CIRCUMSTANCE DIRECTLY INVOLVED IN THE CONTROVERSY IN WHICH SUCH ORDER OR JUDGMENT SHALL BE RENDERED.
SECTION 8.        EFFECTIVE DATE.
THIS LOCAL LAW SHALL TAKE EFFECT IMMEDIATELY UPON FILING IN THE OFFICE OF THE NEW YORK STATE SECRETARY OF STATE.

 
PRESENTATION
TED BERNDT, FOUNDER OF THE WASHINGTON COUNTY AGRI-BUSINESS PARK, DISCUSSED A DETAILED PRESENTATION DISCUSSING HIS FACILITY, DETAILS OF THE NEW YORK STATE MEDICAL MARIJUANA LEGISLATION (COMPASSIONATE CARE ACT OF NY) AND HIS DESIRE TO HAVE HIS FACILITY BE DESIGNATED BY THE STATE OF NEW YORK AS ONE OF FIVE STATEWIDE CULTIVATION CENTERS.  MR. BERNDT SAID THAT THEY WILL NOT ONLY GROW IT, THEY WILL PACKAGE IT AS WELL.  SUPERVISOR HAFF SAID THAT WASHINGTON COUNTY IS RANKED LAST AS 57TH  OUT OF 57 COUNTIES FOR THE DISTRIBUTION OF SALES TAX DOLLARS PER CAPITA.

RESOLUTION NO. 15069
ON MOTION OF SUPERVISOR HAFF, 2ND BY COUNCILMAN DILLON, THE FOLLOWING RESOLUTION WAS ADOPTED 4 AYES, 0 NAYS, 1 ABSENT (FOOTE).  VOTING AYE, SUPERVISOR HAFF, COUNCILWOMAN BEECHER, COUNCILMAN DILLON AND COUNCILMAN DEYOE.
WHEREAS, NEW YORK STATE HAS PASSED THE COMPASSIONATE CARE ACT (THE ACT) ALLOWING FOR THE USE OF MEDICAL MARIJUANA IN CERTAIN FORMS FOR CERTAIN MEDICAL CONDITIONS, AND
WHEREAS, THE ACT PROVIDES FOR THE SITING OF A TOTAL OF FIVE CULTIVATION CENTERS STATEWIDE, OPERATING UNDER REGISTERED ORGANIZATIONS WITH REGULATORY OVERSIGHT BY THE STATE HEALTH DEPARTMENT, AND
WHEREAS, WASHINGTON COUNTY’S LOCATION AND AGRICULTURAL HISTORY MAKE IT A LOGICAL CHOICE FOR A CULTIVATION CENTER, AND
WHEREAS, A CULTIVATION CENTER WOULD ALSO PROVIDE MUCH NEEDED JOBS TO WASHINGTON COUNTY RESIDENTS, AND
WHEREAS, IN 2014 WASHINGTON COUNTY RANKED 57TH OUT OF THE 57 NEW YORK COUNTIES IN THE COLLECTION OF SALES TAX DOLLARS PER CAPITA, AND
WHEREAS, MUCH NEEDED REVENUE WOULD ALSO BE RECEIVED IN THE FORM OF EXCISE TAX ON THE OPERATION, AND
WHEREAS, THE WASHINGTON COUNTY BOARD OF SUPERVISOR’S AGRICULTURE, PLANNING, TOURISM AND COMMUNITY DEVELOPMENT COMMITTEE HAS VOTED TO SUPPORT SUCH SITING AND RECOMMEND THE SAME TO THE FULL WASHINGTON COUNTY BOARD OF SUPERVISORS; NOW THEREFORE BE IT RESOLVED,
THAT THE HARTFORD TOWN BOARD HEREBY SUPPORTS AND REQUESTS THE SITING OF A CULTIVATION CENTER IN WASHINGTON COUNTY PURSUANT TO THE COMPASSIONATE CARE ACT;
AND BE IT FURTHER RESOLVED, THAT A COPY OF THIS RESOLUTION BE SENT TO MEMBERS OF ASSEMBLY STEC, WOERNER AND MCLAUGHLIN, SENATORS LITTLE AND MARCHIONE, NEW YORK DEPT. OF HEALTH SECRETARY, AND NEW YORK GOVERNOR CUOMO.

WHEREAS, REDEVELOPMENT OF THIS LARGE SITE IN THE SOUTHERN SECTION OF WASHINGTON COUNTY WOULD HAVE A LARGE ECONOMIC IMPACT IN BOTH EMPLOYMENT AND REVENUE, AND
WHEREAS, THE COMPASSIONATE RELIEF CENTER OF NEW YORK, INC. MADE A PRESENTATION TO THE HARTFORD TOWN BOARD AND TOWN OF HARTFORD PUBLIC DURING A HARTFORD TOWN BOARD MEETING ON 3/10/15 THAT WAS FAVORABLY RECEIVED, AND
WHEREAS, THE HARTFORD TOWN BOARD HAS ALREADY ENDORSED THE CONCEPT OF A CULTIVATION CENTER WITHIN WASHINGTON COUNTY;

SUPERVISOR HAFF DISCUSSED THE UPCOMING COMMUNITY EVENTS AS FOLLOWS:  MARCH 15 HARTFORD VOLUNTEER FIRE COMPANY PANCAKE BREAKFAST; MARCH 27 HARTFORD CENTRAL SCHOOL TALENT SHOW; MARCH 29 MASON’S HAM DINNER; APRIL 3 FISH & GAME FISH FRY; APRIL 11 METHODIST CHURCH TURKEY DINNER.

 
SUPERVISOR HAFF SAID THAT WASHINGTON COUNTY IS CONSIDERING APPROVING THE SALE WITHIN THE COUNTY OF SPARKLING DEVICES & NOVELTIES THAT ARE LEGAL IN NEW YORK STATE.  THESE ITEMS ARE BEING SOLD IN OTHER COUNTIES AND WASHINGTON COUNTY HAS THE OPTION OF ALLOWING THE SALES WHICH WOULD GENERATE MORE SALES TAX REVENUE FOR THE COUNTY.

 
SUPERVISOR HAFF DISCUSSED THE PRELIMINARY WASHINGTON COUNTY FORECLOSURE LIST FOR 3 YEARS IN ARREARS FOR NONPAYMENT OF TAXES.

 
MEP ELECTRCITY PROVIDER UPDATE
SUPERVISOR HAFF SAID THAT THE TOWN HAS SIGNED A 2 YEAR COMMITMENT TO ELECTRICITY PROVIDER MEP FOR A LOCKED IN RATE OF 7.17 CENTS PER KILOWATT HOUR.

ENFORCEMENT OFFICER REPORT
MARK MILLER SAID THAT HE STILL KEEPING TRACK OF THE HORSES AT 46 TOWNSEND ROAD – HE HAS BEEN IN CONTACT WITH THE LARGE ANIMAL INVESTIGATOR FOR SPCA.  HE SAID HE HAS NOT BEEN ABLE TO TALK TO THE OWNERS DIRECTLY.  MARK SAID THAT HE SIGNED A BUILDING PERMIT FOR DEBBIE WHITE WHO IS TRYING TO BUILD A SMALL STRUCTURE AT HER MOTHER’S HOME ON STATE ROUTE 196.  THEY WILL TRY TO HAVE AN OUTSIDE BARBEQUE TYPE BUSINESS.  MARK SAID THAT HE SOMEONE IS INTERESTED IN BUYING THE STEVE BRITTON PROPERTY BUT IS CONCERNED WITH THE EXPLOSIVES SETBACK REQUIREMENT FOR THE ALPHA BUSINESS ON THE OTHER SIDE OF THE PROPERTY LINE.  MARK CONTACTED JASON STOCKLESS WHO IS AN ATF INVESTIGATOR.  ANYONE CAN BUY THE BRITTON PROPERTY, SITE THEIR NEW HOUSE AND

WHOEVER OWNS THE EXPLOSIVES STORAGE HAS TO MOVE THEM TO ACCOMMODATE THE NEW HOUSE – BASED ON THE QUANTITY OF EXPLOSIVES STORED.  THAT’S WHAT DETERMINES SETBACKS.  SUPERVISOR HAFF ASKED IF THERE WAS ANY UPDATE ON HAYES WAY.  MARK SAID HE HAS NOT HEARD ANYTHING.  SUPERVISOR HAFF DISCUSSED A WELLS FARGO HANDOUT REGARDING PROPERTY PRESERVATION ACTION THAT HE OBTAINED AT THE RECENT ASSOCIATION OF TOWN’S TRAINING IN NEW YORK CITY.  SUPERVISOR HAFF SAID THAT ACCORDING TO THIS INFORMATION IT IS THE MORTGAGE SERVICER (THE ONE WHO PAYS THE TAXES) WHO IS ULTIMATELY IN CHARGE OF FORECLOSURE PROPERTIES.
