A LOCAL LAW TO AMEND HARTFORD TOWN CODE CHAPTER 124 “TAXATION”
LOCAL LAW NO. 1 OF 2017
BE IN ENACTED BY THE TOWN BOARD OF THE TOWN OF HARTFORD:
SECTION 1. TITLE AND AUTHORITY.
THIS LOCAL LAW IS ADOPTED PURSUANT TO THE AUTHORITY VESTED IN THE TOWN BOARD OF THE TOWN OF HARTFORD PURSUANT TO NEW YORK STATE REAL PROPERTY TAX LAW §458-A AND MUNICIPAL HOME RULE LAW §10 OF THE STATE OF NEW YORK.
SECTION 2. PURPOSE.
THE TOWN BOARD FINDS THAT IT IS IN THE BEST INTERESTS OF THE RESIDENTS OF THE TOWN OF HARTFORD TO AMEND ITS TAXATION LAW. IT IS THE INTENTION OF THIS LOCAL LAW TO AMEND CHAPTER 124 TO EXTEND THE COLD WAR VETERANS EXEMPTION TO QUALIFYING OWNERS OF QUALIFYING REAL PROPERTY FOR AS LONG AS THEY REMAIN QUALIFYING OWNERS WITHOUT REGARD TO THE TEN (10) YEAR LIMITATION IN ACCORDANCE WITH NEW YORK STATE REAL PROPERTY TAX LAW §458-B.
SECTION 3. AMENDMENT.
ARTICLE IV SECTION 124-28(C)(3) OF THE TOWN CODE OF THE TOWN OF HARTFORD SHALL BE REPEALED IN ITS ENTIRETY AND REPLACED AS FOLLOWS:
“THE EXEMPTION PROVIDED BY SUBSECTION A OF THIS SECTION SHALL APPLY TO QUALIFYING OWNERS OF QUALIFYING REAL PROPERTY FOR AS LONG AS THEY REMAIN QUALIFYING OWNERS, WITHOUT REGARD TO THE TEN (10) YEAR LIMITATION SET FORTH IN NEW YORK STATE REAL PROPERTY TAX LAW §458-B.”
SECTION 4. SEVERABILITY.
IF ANY CLAUSE, SENTENCE, PARAGRAPH, SUBDIVISION, SECTION, OR PART OF THIS LAW OR THE APPLICATION THEREOF TO ANY PERSON, INDIVIDUAL, CORPORATION, FIRM, PARTNERSHIP, ENTITY, OR CIRCUMSTANCE SHALL BE ADJUDGED BY ANY COURT OF COMPETENT JURISDICTION TO BE INVALID OR UNCONSTITUTIONAL, SUCH ORDER OR JUDGMENT SHALL NOT AFFECT, IMPAIR OR INVALIDATE THE REMAINDER THEREOF, BUT SHALL BE CONFINED IN ITS OPERATION TO THE CLAUSE, SENTENCE, PARAGRAPH, SUBDIVISION, SECTION, OR PART OF THIS LAW, OR IN ITS APPLICATION TO THE PERSON, INDIVIDUAL, CORPORATION, FIRM, PARTNERSHIP, ENTITY, OR CIRCUMSTANCE DIRECTLY INVOLVED IN THE CONTROVERSY IN WHICH SUCH ORDER OR JUDGMENT SHALL BE RENDERED.
SECTION 5. EFFECTIVE DATE.
THIS LOCAL LAW SHALL TAKE EFFECT IMMEDIATELY UPON FILING IN THE OFFICE OF THE NEW YORK STATE SECRETARY OF STATE.

WHEREAS, A PROPOSED LOCAL LAW OPTING OUT OF SECTION 487 OF THE NYS REAL PROPERTY TAX LAW GRANTING CERTAIN EXEMPTIONS FOR ENERGY SYSTEMS IN THE TOWN OF HARTFORD HAS BEEN PREPARED.
NOW, THEREFORE BE IT RESOLVED THAT:
