A LOCAL LAW AMENDING CHAPTER 120 OF THE CODE OF THE TOWN OF HARTFORD LAND SUBDIVISION REGULATIONS
BE IT ENACTED BY THE TOWN BOARD OF THE TOWN OF HARTFORD:
SECTION 1. TITLE AND AUTHORITY.
THIS LOCAL LAW IS ADOPTED PURSUANT TO THE AUTHORITY VESTED IN THE TOWN BOARD OF THE TOWN OF HARTFORD PURSUANT TO ARTICLE 16 OF THE TOWN LAW AND MUNICIPAL HOME RULE LAW § 10 OF THE STATE OF NEW YORK.
SECTION 2. PURPOSE.
THE TOWN BOARD FINDS THAT TO BETTER EFFECTUATE THE PURPOSES AND INTENTIONS OF THE TOWN OF HARTFORD LAND SUBDIVISION REGULATIONS, AND TO ASSIST THE TOWN OF HARTFORD PLANNING BOARD IN THE REVIEW OF SUBDIVISIONS UNDER THE TOWN OF HARTFORD LAND SUBDIVISION REGULATIONS, CERTAIN CHANGES AS CONTAINED HEREIN ARE NECESSARY TO CLARIFY PRECISELY WHAT CONSTITUTES A SUBDIVISION UNDER THE TOWN OF HARTFORD LAND SUBDIVISION REGULATIONS. THESE CHANGES WILL ASSIST THE PLANNING BOARD AND APPLICANTS FOR SUBDIVISION REVIEW IN THE PROPER AND EXPEDITIOUS REVIEW OF SUBDIVISIONS, AND WILL, THEREFORE, PROMOTE THE SAFETY, HEALTH, PROTECTION AND GENERAL WELFARE OF THE PERSONS AND PROPERTY IN THE TOWN OF HARTFORD.
SECTION 3. AMENDMENTS.
A. THE DEFINITION OF AN “PARCEL” AS CONTAINED IN § 120-29 TERMS DEFINED, IS HEREBY REPEALED AND THE FOLLOWING ADOPTED IN ITS PLACE:

B. THE DEFINITION OF AN “SUBDIVISION” AS CONTAINED IN § 120-29 TERMS DEFINED, IS HEREBY REPEALED AND THE FOLLOWING ADOPTED IN ITS PLACE:
SUBDIVISION
THE DIVISION OF ANY PARCEL OF LAND INTO TWO OR MORE LOTS, PLOTS, SITES FOR THE PURPOSE, WHETHER IMMEDIATE OR FUTURE, OF LOT LINE ALTERATION, TRANSFER OF OWNERSHIP, LEASE FOR OTHER THAN RECREATION, CONSERVATION OR AGRICULTURAL PURPOSES, OR BUILDING DEVELOPMENT.
C. THE DEFINITION OF AN “EXEMPT SUBDIVISION” AS CONTAINED IN § 120-29 TERMS DEFINED, IS HEREBY REPEALED AND THE FOLLOWING ADOPTED IN ITS PLACE:
SUBDIVISION, EXEMPT
THE DIVISION OF LAND FOR SALE OR TRANSFER SHALL BE EXEMPT FROM THE SUBDIVISION REGULATIONS CONTAINED IN THIS CHAPTER, PROVIDE THE LOT(S) BEING CREATED SHALL OTHERWISE CONFORM TO THE DESIGN REQUIREMENTS OF A MINOR SUBDIVISION, AS FOLLOWS:
(1) THE DIVISION OF LAND BEING CONVEYED TO A SPECIFIC FAMILY MEMBER, LIMITED TO THE OWNER(S)’ PARENTS, CHILDREN, GRANDPARENTS, OR GRANDCHILDREN;
(2) THE DIVISION OF LAND AND TRANSFER OF LAND FOR AN EXPRESSED AGRICULTURAL PURPOSE;
(3) THE SALE OR EXCHANGE OF PARCELS OF LAND BETWEEN OWNERS OF ADJOINING PROPERTY IF ADDITIONAL LOTS ARE NOT CREATED; OR
(4) THE DIVISION OF CONTIGUOUS PARCELS, THE BOUNDARIES OF WHICH ARE INDEPENDENT DESCRIBED BY METES AND BOUNDS, OR WHICH WERE A PART OF A PREVIOUSLY APPROVED SUBDIVISION, AS RECORDED IN THE OFFICE OF THE WASHINGTON COUNTY CLERK. THIS INCLUDES PARCELS THAT HAVE BEEN COMBINED FOR REAL PROPERTY TAX REASONS.
SECTION 4. SEVERABILITY.
IF ANY CLAUSE, SENTENCE, PARAGRAPH, SUBDIVISION, SECTION, OR PART OF THIS LAW OR THE APPLICATION THEREOF TO ANY PERSON, INDIVIDUAL, CORPORATION, FIRM, PARTNERSHIP, ENTITY, OR CIRCUMSTANCE SHALL BE ADJUDGED BY ANY COURT OF COMPETENT JURISDICTION TO BE INVALID OR UNCONSTITUTIONAL, SUCH ORDER OR JUDGMENT SHALL NOT AFFECT, IMPAIR OR INVALIDATE THE REMAINDER THEREOF, BUT SHALL BE CONFINED IN ITS OPERATION TO THE CLAUSE, SENTENCE, PARAGRAPH, SUBDIVISION, SECTION, OR

ON MOTION OF SUPERVISOR HAFF, 2ND BY COUNCILWOMAN PEREZ, THE FOLLOWING RESOLUTION WAS ADOPTED 5 AYES, 0 NAYS. VOTING AYE, COUNCILWOMAN BEECHER, COUNCILMAN BURCH, COUNCILMAN HARRINGTON, COUNCILWOMAN PEREZ AND SUPERVISOR HAFF.
WHEREAS, PURSUANT TO SECTION 276 OF TOWN LAW AND SECTION 10 OF MUNICIPAL HOME RULE LAW, THE TOWN BOARD (THE “BOARD”) OF THE TOWN OF HARTFORD (THE “TOWN”) HAS THE AUTHORITY TO ADOPT LOCAL LAWS CONCERNING THE REVIEW OF SUBDIVISION PLATS BY THE TOWN OF HARTFORD PLANNING BOARD; AND
WHEREAS, THERE EXISTED CERTAIN AMBIGUITY IN THE DEFINITIONS OF PARCEL, SUBDIVISION, AND EXEMPT SUBDIVISION THAT THE TOWN WISHED TO CLARIFY AND PROVIDE GREATER CERTAINTY TO THE PUBLIC; AND
WHEREAS, THE TOWN FINDS AND DETERMINES THAT THIS LOCAL LAW IS NECESSARY TO PROTECT THE HEALTH, SAFETY AND WELFARE OF ITS CITIZENS; AND
WHEREAS, THE TOWN SCHEDULED A PUBLIC HEARING TO BE HELD BEFORE THE TOWN BOARD ON APRIL 13, 2021 AT 8:00 PM AT THE OFFICE OF THE TOWN OF HARTFORD, 165 HARTFORD MAIN STREET, HARTFORD, NEW YORK, TO HEAR ALL INTERESTED PARTIES REGARDING THE ADOPTION OF A PROPOSED LOCAL LAW AMENDING THE TOWN OF HARTFORD LAND SUBDIVISION REGULATIONS, AND
WHEREAS, NOTICE OF SAID PUBLIC HEARING WAS DULY POSTED AND THEN PUBLISHED IN THE OFFICIAL NEWSPAPER OF THE TOWN, PURSUANT TO AND IN CONFORMANCE WITH SECTION 20 OF THE MUNICIPAL HOME RULE LAW; AND
WHEREAS, SAID PUBLIC HEARING WAS DULY HELD AND ALL PARTIES IN ATTENDANCE WERE PERMITTED AN OPPORTUNITY TO SPEAK ON BEHALF OR IN OPPOSITION TO THE PROPOSED LOCAL LAW; AND
WHEREAS, THE TOWN DECLARED THAT THIS ACTION IS A TYPE 2 ACTION PURSUANT TO THE STATE ENVIRONMENTAL QUALITY REVIEW ACT (“SEQRA”), AS CODIFIED UNDER 6 NYCRR PART 617 ET. SEQ.
NOW, THEREFORE BE IT
RESOLVED, BY THE TOWN BOARD OF THE TOWN OF HARTFORD AS FOLLOWS:
SECTION 1. THE BOARD, UPON DUE DELIBERATION OF THE PROPOSED LOCAL LAW AND THE COMMENTS PRESENTED AT THE PUBLIC HEARING, FINDS THAT THE ADOPTION OF THE SAME SHALL BE IN THE BEST INTERESTS OF THE TOWN.
SECTION 2. THE PROPOSED LOCAL LAW IS HEREBY ADOPTED, COPIES OF WHICH ARE ATTACHED HERETO AND MADE A PART HEREOF. THE LAW SHALL TAKE EFFECT IMMEDIATELY UPON ITS FILING IN THE OFFICE OF THE SECRETARY OF STATE.
SECTION 3. THE CLERK IS HEREBY INSTRUCTED TO FILE A CERTIFIED COPY OF THE LOCAL LAW WITH THE SECRETARY OF STATE.
SECTION 4. THIS RESOLUTION SHALL TAKE EFFECT IMMEDIATELY.

SUPERVISOR HAFF SHOWED A COPY OF THE MEMORIAL DAY PARADE ADVERTISEMENT THAT WILL BE PUBLISHED IN THE CHRONICLE , SENTINEL ETC. HE SAID THAT PARTICIPANTS WILL NEED TO SOCIAL DISTANCE AND IT SHOULD BE EASY ENOUGH SINCE THE PARADE ROUTE IS OVER 1 MILE LONG.

SUSPICIOUS ACTIVITY
SUPERVISOR HAFF SAID THAT HE HAD RECEIVED COMPLAINTS ABOUT SUSPICIOUS ACTIVITY REGARDING A PERSON THAT WAS IDENTIFIED DRIVING AROUND A BLACK LEXUS. THE PERSON IS A BURGLARY FELON ON PAROLE AND IT SEEMED LIKE HE WAS GOING AROUND CASING OUT PROPERTIES. SUPERVISOR HAFF SUGGESTED THAT CITIZENS CONTACT 911 AND THE WASHINGTON COUNTY SHERIFF REGARDING ANY SUSPICIOUS ACTIVITY.
TOWN-WIDE CLEAN UP DAY
SUPERVISOR HAFF SAID THAT TOWNWIDE CLEAN UP DAY WILL BE HELD ON SATURDAY 4/24/21, 9-NOON AND FREE HOT DOG LUNCH WILL BE PROVIDED AT NOON.

WHEREAS, THE TOWN BOARD OF THE TOWN OF HARTFORD HAS REVIEWED CHAPTER 130 OF THE HARTFORD TOWN CODE AS IT PERTAINS TO THE TRAVEL OF ALL-TERRAIN VEHICLES (“ATVS”) ON TOWN ROADS; AND
WHEREAS, THIS BOARD HAS BEEN REQUESTED TO ADOPT A LOCAL LAW ENACTING CERTAIN MODIFICATIONS TO FOSTER THE GENERAL PUBLIC’S ACCESS TO DESIGNATED ATV TRAILS OVER TOWN ROADS; AND
WHEREAS, THIS BOARD HAS BEEN PRESENTED WITH AND HAS INTRODUCED A DRAFT LOCAL LAW NO. 3 OF 2021 TO RESOLVE SAID ISSUE, AMENDING SECTION 130-7 OF THE HARTFORD TOWN CODE.
NOW, THEREFORE, BE IT RESOLVED,
THAT PURSUANT TO SECTION 20 OF THE MUNICIPAL HOME RULE LAW OF THE STATE OF NEW YORK, A PUBLIC HEARING ON SAID PROPOSED LOCAL LAW NO. 3 SHALL BE HELD ON THE 11TH DAY OF MAY, 2021 AT 7:05PM AT THE OFFICES OF THE TOWN OF HARTFORD, 165 HARTFORD MAIN STREET, HARTFORD, NEW YORK, AND THAT NOTICE OF THE TIME AND PLACE OF SUCH HEARING DESCRIBING IN GENERAL TERMS THE PROPOSED LOCAL LAW, BE PUBLISHED IN THE TOWNS OFFICIAL NEWSPAPER..
YOUTH COMMISSION
SUPERVISOR HAFF SAID THAT HE SPOKE WITH RON SMITH, CHAIRPERSON OF THE YOUTH COMMISSION AND AMBER MERCURE REGARDING HOW THE YOUTH COMMISSION MIGHT BE USING THE ARGYLE YOUTH COMMISSION BASEBALL/SOFTBALL FIELDS BECAUSE THEY ARE NOT LOCATED ON SCHOOL PROPERTY. SCHOOL PROPERTY REMAINS CLOSED DUE TO SCHOOL COVID RESTRICTIONS.
HIGHWAY SUPERINTENDENT REPORT
GREG BROWN DISCUSSED THAT THE TOWN DOESN’T HAVE TO HAVE A CONTRACT WITH THE BURN PLANT ANYMORE, THE TOWN CAN JUST TAKE THE GARBAGE OUT AND PAY WITH THE DEBIT CARD. GREG SAID THAT THE STATE IS STILL TALKING ABOUT THE AMOUNT OF MONEY THAT WILL BE GIVEN FOR THE CHIPS DISTRIBUTION. HE SAID HE HAS NO IDEA AND WILL BE PLANNING ON SPENDING THE 80% AS ORIGINALLY ANNOUNCED. HE SAID THAT THE TOWN OF ARGYLE IS IN A HURRY TO PAVE THEIR HALF OF MCDOUGALL ROAD AND HE WOULD LIKE TO PAVE THE HARTFORD PORTION AS WELL. GREG SAID THAT FOR CULVERT NY HE HAS BEEN WORKING ON GETTING PAPERWORK READY TO SUBMIT FOR THE MONEY FOR THE 2 CULVERTS – 1 ON WARREN ROAD AND THE OTHER ON BALDWIN CORNERS ROAD. THE TOWN WILL NOT KNOW IF IT IS AWARDED THE MONEY UNTIL NOVEMBER 2021. THEN THE PROJECTS WILL BE SCHEDULED IN 2022 AND 2023. SUPERVISOR HAFF ASKED WHY GREG WAS BUYING MORE TRAFFIC CONES. HE SAID THAT THEY ARE STOLEN ALL THE TIME.

ENFORCEMENT OFFICER REPORT
MARK MILLER SAID THAT HE SIGNED A LRCC2 FOR JOHN LOGAN FOR A SHED ON COUNTY ROUTE 30. HE REPORTED TO THE COUNTY THAT SARAH LOSCALZO AT 231 GIBBS ROAD WAS BUILDING A NEW PORCH. SAM NOLAN IS BUYING THE LAVIN FARM AND NOW HE NEEDS A BUILDING PERMIT ONCE THE CLOSING IS COMPLETE. MARK SAID THAT THERE WAS A MOBILE HOME BROUGHT IN ON THE SWEZEY FARM AND THE LAW STATES THAT IT IS PERMISSIBLE FOR FAMILY MEMBER FARM HANDS. SUPERVISOR HAFF ASKED IF A FAMILY MEMBER WAS GOING TO LIVE THERE. MARK SAID HE THOUGHT THAT DAVID SWEZEY WAS GOING TO BE PRESENT AT THIS MEETING NOW TO DISCUSS IT. SUPERVISOR HAFF SAID THAT THE TRAILER WAS NOT SUPPOSED TO BE BROUGHT IN WITHOUT MARK INSPECTING IT. MARK SAID THAT FARMS DON’T HAVE TO MEET

THE SAME REQUIREMENTS FOR MOBILE HOMES. SUPERVISOR HAFF SAID THAT THE MOBILE HOME LAW PERMITS WATER SHARING. MARK SAID THAT IF IT IS NO LONGER BEING USED BY A FARM HAND IN THE FUTURE, THEN THE TOWN BOARD WOULD HAVE TO APPROVE OF THE RENTAL USE. MARK SAID THAT HE SUGGESTS THAT A WELL BE INSTALLED IN CASE OF FUTURE USE RESTRICTIONS. SUPERVISOR HAFF ASKED MARK TO SHOW IN THE LAW WHERE IT SAYS THAT IT DID NOT NEED TO BE INSPECTED BEFORE IT WAS BROUGHT INTO TOWN. THE FARM CLAUSE SECTION 79.9 WAS READ OUT LOUD. SUPERVISOR HAFF SAID THAT THIS SECTION SAYS THAT FARM MOBILE HOMES MUST COMPLY TO THE MOBILE HOME LAW IN ALL RESPECTS EXCEPT FOR ALLOWING THE MOBILE HOME TO SHARE A WELL. SUPERVISOR HAFF SAID THAT THIS MOBILE HOME HAS TO COMPLY WITH ALL ASPECTS OF THE LAW. MARK SAID THAT HE TOLD DAVID TO JUST SET IT THERE BEFORE DOING ANY INSTALLATION WORK. SUPERVISOR HAFF READ SECTION 79.4 B THAT SAYS NO MOBILE HOME CAN BE MORE THEN 10 YEARS OLD UNLESS ACCEPTABLY INSPECTED PRIOR TO BRINGING INTO THE TOWN. HE SAID THE AGE OF THE MOBILE HOME WOULD REQUIRE A WAIVER. MARK SAID THAT DAVID SWEZEY TOLD HIM THAT IT CAME FROM A MOBILE HOME PARK. SUPERVISOR HAFF DISCUSSED SECTION 79.7 B REGARDING THE INSPECTION REQUIREMENT AND TOWN BOARD PUBLIC HEARING PROCEDURES. THERE WAS FURTHER DISCUSSION REGARDING THE AGE OF THE MOBILE HOME AND THE FACT THAT THE HOME HAS BEEN BROUGHT INTO TOWN BEFORE ALL REQUIREMENT OF THE LAW HAVE BEEN MET.
MARK SAID THAT DAVE LAPIER HAS UNTIL 4/15/21 TO REMOVE MORE OF THE CARS ON HIS PROPERTY. MARK SAID THAT TRAVIS OGDEN LOCATED AT 14 HARTFORD MAIN STREET IS WORKING ON CLEANING UP HIS PROPERTY AS WELL.
