SUPERVISOR HAFF SAID THAT IT IS NEARING BUDGET TIME AND HE SAID THAT HE HAS REQUESTED EACH DEPARTMENT TO SUBMIT THEIR BUDGET REQUESTS.  THE HIGHWAY DEPARTMENT WILL BE RECEIVING A 1.5% SALARY INCREASE SO HE HAS ASKED ALL OTHER EMPLOYEES TO ALSO KEEP TO THE 1.5% INCREASE.

 
TIME WARNER FRANCHISE RENEWAL
SUPERVISOR HAFF SAID THAT THE TIME WARNER FRANCHISE RENEWAL HAS BEEN APPROVED BY THE STATE OF NEW YORK PUBLIC SERVICE COMMISSION.  IT IS EFFECTIVE JULY 19, 2012 FOR TEN YEARS.
 
STOLEN HIGHWAY SIGNS RESTITUTION
SUPERVISOR HAFF SAID THAT THEY TOWN HAS RECEIVED A LETTER FROM ATTORNEY ROBERT WINN AND CHECK IN THE AMOUNT OF $100 FOR TOWN OF HARTFORD HIGHWAY SIGNS THAT WERE IN POSSESSION OF JUSTIN ALDOUS.  MR. ALDOUS WAS FOUND IN POSSESSION OF THE SIGNS AND NEEDED TO MAKE RESTITUTION FOR THE SIGNS TO THE TOWN.

ELECTING DIRECT PAYMENT OF WASHINGTON COUNTY SALES AND COMPENSATING USE TAX ALLOCATION
RESOLUTION NO. 12192
ON MOTION OF SUPERVISOR HAFF, 2ND BY COUNCILMAN MCCARTHY, THE FOLLOWING RESOLUTION WAS ADOPTED 5 AYES, 0 NAYS.  VOTING AYE, SUPERVISOR HAFF, COUNCILWOMAN BEECHER, COUNCILWOMAN FOOTE, COUNCILMAN GALLINARI AND COUNCILMAN MCCARTHY.
WHEREAS, WASHINGTON COUNTY IMPOSES SALES AND COMPENSATING USE TAXES PURSUANT TO THE AUTHORITY OF SECTION 1210 OF THE TAX LAW OF THE STATE OF NEW YORK; AND
WHEREAS, WASHINGTON COUNTY HAS ELECTED TO ALLOCATE A PORTION OF THE NET COLLECTIONS FROM ITS SALES AND USE TAXES TO THE TOWNS IN THE COUNTY; AND
WHEREAS, SECTION 1262 ( C) OF THE NEW YORK TAX LAW AUTHORIZES A TOWN TO ELECT TO BE PAID ALL OR A SPECIFIED PART OF ITS SHARE OF THE COUNTY’S ALLOCATION DIRECTLY, IN LIEU OF REDUCTION OF COUNTY TAXES AND GENERAL TOWN TAXES LEVIED UPON REAL PROPERTY IN SUCH TOWN; AND
WHEREAS, THE TOWN BOARD NOW DESIRES TO MAKE SUCH ELECTION;
NOW, THEREFORE, BE IT RESOLVED, THAT THE TOWN OF HARTFORD HEREBY ELECTS TO BE PAID DIRECTLY ALL OF ITS SHARE OF WASHINGTON COUNTY’S SALES AND COMPENSATING USE TAX NET COLLECTIONS, FOR CALENDAR YEAR 2013 AND THEREAFTER; AND
BE IT FURTHER RESOLVED, THAT PURSUANT TO SUCH SECTION 1262 ( C) OF THE TAX LAW, A COPY OF THIS RESOLUTION SHALL IMMEDIATELY BE MAILED BY CERTIFIED OR REGISTERED MAIL TO THE CHIEF FISCAL OFFICER OF WASHINGTON COUNTY AND TO THE CLERK OF THE WASHINGTON COUNTY BOARD OF SUPERVISORS BEFORE SEPTEMBER 1, 2012, FOR THIS ELECTION TO TAKE EFFECT JANUARY 1, 2013; AND

FARMLAND PROTECTION PLAN
SUPERVISOR HAFF SAID THAT ON AUGUST 2, 2012 THE WASHINGTON COUNTY AG & FARMLAND PROTECTION BOARD APPROVED THE TOWN’S FARMLAND PROTECTION PLAN WITH ONE RECOMMENDATION – SPELL OUT HOW WE WOULD PREFER LAND TO BE ELIGIBLE FOR CONSERVATION.  HE SAID THAT BRANDI SAXTON, CONSULTANT SAID THAT IN THE PLAN – WE DO NOT NAME PROPERTIES BECAUSE WE DO NOT HAVE JUST 5 FARMS – WE HAVE A LOT OF FARM LAND.  IT WOULD BE TOO MUCH TO LIST THEM SEPARATELY – SO WE REFER TO THE SOIL MAPS AND THE ONES WITH THE BEST SOILS WOULD BE PRIORITY.  THE PLAN WILL BE REVISED TO SPELL IT OUT MORE CLEARLY.  SUPERVISOR HAFF SAID THAT ONCE HE RECEIVES THE REVISION HE WILL SEND IT TO THE STATE AG & MARKETS.

 
SCHOOL ATHLETIC FIELD UPDATE
RON SMITH SAID THAT VOLUNTEERS HAVE BEEN WORKING A LITTLE OVER 2 WEEKS ON THE SCHOOL FIELD PROJECT.  HE SAID THAT THEY ARE MAKING GOOD PROGRESS WITH MANY PEOPLE STOPPING BY TO OFFER SUPPORT AND DONATIONS.  RON SAID THAT THEY HAVEN’T FOUND ANYTHING BURIED YET THAT CANNOT BE MOVED.  SUPERVISOR HAFF DISCUSSED THE MANY PIECES OF EQUIPMENT ON SITE.  HE SAID HE TALKED WITH GREG BROWN, HIGHWAY SUPERINTENDENT REGARDING USING THE TOWN’S SURPLUS TRUCK AT THE SITE.  GREG SAID THAT IT IS POSSIBLE THE TRUCK BID WAS NOT ADVERTISED ENOUGH.  HE WOULD LIKE TO REQUEST THAT IT BE REBID AND RUN ON CONSECUTIVE FRIDAY, SATURDAY AND SUNDAY.  SINCE IT IS NO LONGER A FRONT LINE TRUCK FOR THE DEPARTMENT, AND AFTER A CONVERSATION WITH DICK LOOK, THE TOWN INSURANCE AGENT; GREG WOULD LIKE TO SEND THE TRUCK DOWN TO BE USED AT THE PROJECT.  AT THE END OF THE DAY A FOR SALE SIGN WILL BE PLACED IN IT AND IT WILL BE PARKED NEAR THE ROAD.  SUPERVISOR

HAFF SAID THAT HE ALSO SPOKE WITH DICK LOOK REGARDING USING THE TRUCK AT THE PROJECT.  HE SAID THE CONCERN WAS IF IT WOULD BE USED OVER THE HIGHWAY.  SUPERVISOR HAFF TOLD HIM NO, IT WOULD BE USED IN THE FIELD ETC.  AS LONG AS THE TRUCK IS STILL OWNED BY THE TOWN IT IS STILL COVERED UNDER OUR POLICY IT SHOULD BE FINE.  RON SMITH SAID THAT THE RENTED BULLDOZER USE IS LIMITED BY HOURS – THERE ARE STILL 42 HOURS LEFT – SO APPROXIMATELY 1 MORE WEEK.  GREG SAID THAT HE SPOKE WITH IAN MILLER,  FROM NYS DOT REGARDING THE POSSIBLE EXTENSION OF AN EXISTING CULVERT ONSITE AT STATE ROUTE 149 – SO THAT THE AREA WOULD BE ACCESSIBLE BY FOOT OR EMERGENCY VEHICLE IF NECESSARY.  GREG DISCUSSED THAT HE HAS HEARD RUMOR THAT THE “GOOD TOPSOIL” IS BEING BURIED UNDER THE OTHER.  HE SAID HE HAS BEEN DOWN TO THE FIELD AND IT APPEARS TO BE ALL GOOD SAND AND GRAVEL – AND NO CONTAMINATED SOIL.  SUPERVISOR HAFF ASKED IF THE PROJECT DIRECTORS WERE HAVING ALL VOLUNTEERS COMPLETE THE INSURANCE WAIVER FORMS.  RON SMITH AND SAM IRWIN SAID THAT THEY WERE NOT AWARE OF THE FORM – BUT WILL GET THEM COMPLETED.

 
FLOOD PLAIN PERMIT FORM
SUPERVISOR HAFF ASKED MARK MILLER, ENFORCEMENT OFFICER THE STATUS OF HIS FLOOD PLAN PERMIT FORM.  MARK SAID THAT HE REVIEWED IT AND IN DISCUSSION WITH BILL MCCARTY, COUNTY DIRECTOR OF CODE ENFORCEMENT, BILL SAID THAT IN ORDER TO GUIDE PEOPLE WHEN THEY WANT TO BUILD IN A FLOOD PLAIN AREA – NO COUNTY OR STATE GRADATION WITH PROPERTY LINES SUPERIMPOSED MAP EXISTS.  BILL SAID THAT HE HOPES THE DEC OR ARMY CORP AND COUNTY COULD COMBINE THEIR INFORMATION TO CREATE THIS TYPE OF MAP FOR REFERENCE.  SUPERVISOR HAFF SAID THAT THERE IS A FLOOD PLAIN QUESTION ON THE COUNTY LRCC FORM.  HE SAID IF THE COUNTY IS ASKING THE QUESTION – HOW IS IT ANSWERED?  MARK SAID THAT IT WOULD NEED TO BE PHYSICALLY INVESTIGATED TO TRY TO DETERMINE.  SUPERVISOR HAFF WILL BRING THIS UP FOR FURTHER DISCUSSION AT THE COUNTY LEVEL.

 
TRUCK BIDS
SUPERVISOR HAFF SAID THAT NO FORMAL BIDS WERE RECEIVED.  HE SAID THAT HE FEELS THAT IT SHOULD BE PUT UP FOR REBID.

RESOLVED TO RE-ADVERTISE FOR BIDS AGAIN ON THE 1997 SINGLE AXLE INTERNATIONAL DUMP TRUCK ON CONCURRENT FRIDAY, SATURDAY AND SUNDAY WITH NO $5000 MINIMUM BID REQUIREMENT.  BIDS TO BE SUBMITTED BY NOON FRIDAY, SEPTEMBER 7, 2012  SO THAT THEY CAN BE FORWARDED TO THE TOWN BOARD MEMBERS FOR REVIEW PRIOR TO THE SEPTEMBER 11, 2012 MEETING.

SUPERVISOR HAFF SAID THAT THE FEEDBACK WAS POSITIVE FOR THE TOWNWIDE GARAGE SALE.

 
ALTERNATE MEMBERS OF YOUTH COMMISSION
RESOLUTION NO. 12194

YOUTH COMMISSION REPORT
RON SAID THAT THE BASEBALL/SOFTBALL SEASON WAS VERY SUCCESSFUL THIS YEAR AND ALL EQUIPMENT HAS BEEN TURNED IN AND WILL BE INVENTORIED TO SEE WHAT WILL NEED TO BE REPLACED NEXT YEAR.  THEY HELD A SOCCER SIGNUP AND COOKOUT ON SATURDAY DURING THE TOWNWIDE GARAGE SALE AND IT WAS FAIRLY SUCCESSFUL.  SUPERVISOR HAFF SAID THAT ANYTHING THAT IS SOLD DIRECTLY OUT OF THE SNACK SHACK ETC., THE TOWN HAS TO PAY NYS SALES TAX ON IT.  WHAT JOEL HAS DONE IN THE PAST IS TAKEN THE RECEIPT FOR ITEMS SOLD AND TAKES 7% FROM IT FOR THE STATE.  HE THINKS IT WOULD BE A GOOD IDEA TO CREATE SIGNS THAT SAY “NYS SALES TAX INCLUDED” IN THE PRICE OF ITEMS.  IF THE YOUTH COMMISSION SELLS ANYTHING THRU A CATALOG ETC.  – THAT VENDOR PAYS THE SALES TAX – THE YOUTH COMMISSION WOULD NOT HAVE TO.

COUNCILMAN MCCARTHY SUMMARIZED THE MONTH OF JULY CALL REPORT.

RESOLVED THAT THE HARTFORD VOLUNTEER FIRE COMPANY REPORT BE ACCEPTED.

 
HIGHWAY SUPERINTENDENT REPORT
GREG BROWN SAID THAT THE CREW IS HAPPY WITH THE NEW TRUCK.  HE SAID THAT THE LARGE SALT BILL IN THE ABSTRACT WAS THE AMOUNT HE WAS REQUIRED TO PURCHASE ON THE STATE CONTRACT PRICE.  HE SAID THAT IT IS QUITE A LARGE PILE AND IT IS BEING STORED FOR FREE,  COVERED AT CHUCK FRIEDMAN’S FACILITY ON A BLACKTOP PAD.  WHEN WE NEED IT WE CAN GO AND GET IT BECAUSE WE DO NOT HAVE THE ROOM HERE AT TOWN HALL.  GREG DISCUSSED SOME LINE ITEM BUDGET TRANSFERS THAT HE WOULD LIKE TO MAKE FOR CHIPS PERMANENT IMPROVEMENTS FOR THE GILCHRIST HILL PROJECT.  HE SAID THAT HE HAS MORE THAN ENOUGH SAND AND SALT TO FINISH THE REST OF THE YEAR SO THERE IS EXCESS MONEY IN SNOW REMOVAL CONTRACTUAL.  SUPERVISOR HAFF ASKED WHEN WE SHOULD EXPECT TO RECEIVE THE CHIPS MONEY FROM THE STATE – GREG SAID HE VERIFIED THE PROPER PAPERWORK HAS BEEN SUBMITTED AND IT SHOULD BE ANYTIME SOON. COUNCILWOMAN BEECHER AND COUNCILMAN MCCARTHY BOTH ASKED FOR FIGURES REGARDING HOW MUCH THE GILCHRIST HILL PROJECT IS COSTING.  GREG SAID 2 DRIVEWAYS NEEDED TO BE EXTENDED TO REACH THE NEW ROAD.  GREG EXPLAINED THAT THE COUNTY HAS BEEN UP THERE DOING SOME SURVEYING AND THEY ARE GOING TO MOVE THE ROAD AND SURVEY THE SURROUNDING PROPERTY.  MR. BAKER DOES NOT WANT THE PROPERTY ON THE OTHER SIDE OF THE ROAD BECAUSE IT IS NOT OF ANY USE TO HIM.  SIMON SULZER AND PETE KLAIBER HAVE SAID THAT THEY WILL TALK WITH SANDRA FOLEY, ASSESSOR REGARDING THE PROPERTY.  DICK BAKER IS GOING TO SIGN THE LAND OVER TO THEM.  THIS WAY, IT STAYS ON THE TAX ROLL AND THE TOWN DOESN’T END UP WITH IT.  SUPERVISOR HAFF SAID THAT HE WAS IN AWE AT THE SCOPE OF THE WORK BUT WE HAVE HAD A MILD WINTER, GREG HAS MONEY IN THE BUDGET AND WE ARE NOT ASKING TO TAX PEOPLE FOR THE WORK – IT IS ALL BEING DONE IN THIS BUDGET.  COUNCILMAN MCCARTHY ASKED IF THE MOWING TRACTOR WAS REPAIRED YET – GREG SAID IT WAS RUNNING BUT NOW IT IS HAVING ISSUES AGAIN – THEY ARE WORKING ON IT.

ENFORCEMENT OFFICER REPORT
MARK MILLER SAID THAT HE HAS SIGNED SEVERAL BUILDING PERMITS.  RAY HOARD IS HARVESTING LOGS FROM HIS PROPERTY AND WILL BE BUILDING A LOG HOME.  HE SAID JAMES CHRISTMAN ON CHRISTIAN HILL WHO WILL BE PUTTING IN A SOLAR ARRAY.  HE SAID SOMEONE ELSE ON WRIGHT ROAD IS PLANNING TO INSTALL SOLAR AS WELL.  MARK SAID THAT FRANK MCFARREN, ON ROJCEWICZ LANE IS STILL WAITING FOR HIS WATER TEST.  JARED EVANS HAS STOPPED ON THE WEST SIDE ROOF – HE TOOK OFF SLATE, REPLACED THE VALLEYS AND PUT CORRUGATED METAL.  MARK WILL CONTACT HIM TO ENCOURAGE HIM TO CONTINUE.  HE HAS BEEN IN CONTACT WITH THE COUNTY AND THEY HAVE DECIDED TO ENCOURAGE JARED TO CONTINUE INSTEAD OF PRESSURING HIM WITH COURT ISSUES AT THIS TIME.  SUPERVISOR HAFF SAID THAT JARED EVANS IS MAKING PROGRESS.

DCO REPORT
SUPERVISOR HAFF REVIEWED THE DOG CONTROL REPORT.  THERE WAS DISCUSSION REGARDING PIT BULLS RUNNING IN MORNINGSIDE CEMETERY.  HE SAID THAT NANCY QUELL CONTACTED BARB LIEBIG AND JANET ROCK REGARDING THIS ISSUE.  A COMPLAINT FORM WAS FILED AND THE OWNER HAS BEEN CITED.  MARK MILLER ASKED ABOUT ANOTHER PIT BULL RUNNING FREE IN EAST HARTFORD – POSSIBLY SANDY DEWEY’S DOG.

RESOLVED TO POST FOR BOARD OF ASSESSMENT REVIEW VACANCY.  SUBMISSIONS TO BE RECEIVED BY NOON FRIDAY, SEPTEMBER 7, 2012  SO THAT THEY CAN BE FORWARDED TO THE TOWN BOARD MEMBERS FOR REVIEW PRIOR TO THE SEPTEMBER 11, 2012 MEETING.

PUBLIC DISCUSSION
BILL KNAPP SAID THAT HE WORKED ON GETTING THE TRAILER REQUIREMENTS TO MEET THE TOWN CODE.  HE HAS FILED THE ACRE OF LAND SUBDIVISION REQUIREMENT WITH THE COUNTY.  HE WOULD LIKE TO REMOVE THE OLD TRAILER AND MOVE THE NEW ONE IN.  ACCORDING TO MARK’S LETTER, THE ONLY THING HE WOULD NOT BE ABLE TO MEET IS PUTTING THE PUMP IN THE WELL AT THIS TIME.  HE SAID THAT AT THE LAST MEETING IT WAS SUGGESTED THAT HE COULD SIGN A PAPER STATING THAT IF EITHER HIS DAUGHTER OR HE SOLD THE PROPERTY – THEY COULD INSTALL A PUMP AND SEVER THE WATER LINE AT THAT TIME.  IT WOULD NOT BE DOABLE FOR HIM TO SAY THAT HE WOULD PUT A PUMP IN HER WELL, WHICH HE WOULD; HE WOULD HAVE NO RIGHT UNLESS SHE GAVE HIM PERMISSION.  SUPERVISOR HAFF SAID THAT PROPOSITION DID NOT GO ANYWHERE – SO THAT IS NOT AN OPTION ANYMORE.  HE SAID THAT THE TOWN EMPLOYS AN ENFORCEMENT OFFICER, WHO KNOWS THE MOBILE HOME LAW.  SUPERVISOR HAFF SAID THAT HE DOES NOT WANT TO CIRCUMVENT THE AUTHORITY OF OUR ENFORCEMENT OFFICER.  ALL OF THESE ISSUES RAISED – NEED TO BE HANDLED THROUGH MARK MILLER – NOT THE TOWN BOARD. BILL SAID THAT MARK TOLD HIM THAT HE CAN’T SAY YES TO HIM – BECAUSE THE TOWN BOARD COULD TURN AROUND AND SAY NO DOWN THE ROAD.  SUPERVISOR HAFF SAID THAT IN ORDER FOR THE TOWN BOARD TO SCHEDULE A PUBLIC HEARING FOR THE TRAILER, THE MOBILE HOME APPLICATION HAS TO BE COMPLETE PER THE ENFORCEMENT OFFICER.  SUPERVISOR HAFF SAID THAT HE IS NOT GOING TO MICRO-MANAGE MARK OR HIS JOB.   HE SAID THE CONVERSATION NEEDS TO BE BETWEEN MARK AND BILL KNAPP.  MR. KNAPP WAS UNDER THE IMPRESSION THAT THE PUBLIC HEARING WAS ALREADY SCHEDULED – SUPERVISOR HAFF EXPLAINED THAT HE NEEDS TO BE IN COMPLIANCE BASED ON THE ENFORCEMENT OFFICER’S DECISION.  AFTER THAT IS DETERMINED, A PUBLIC HEARING CAN BE SCHEDULED.

 
PAUL DONALDSON SAID THAT HE HAD RECEIVED A FUND RAISER LETTER FROM THE FORT ANN RESCUE SQUAD.  SUPERVISOR HAFF SAID THAT THE TOWN CONTRACT’S WITH THE ARGYLE EMS – NOT FORT ANN.  HOWEVER, FORT ANN DOES SERVE BALDWIN CORNERS ROAD.  PAUL ASKED ABOUT THE INTERSECTION OF SHINE HILL ROAD AND STATE ROUTE 196 BEING A TIGHTER TURN AND IF IT WOULD BE FIXED.  GREG BROWN SAID THAT IT WILL NOT BE FIXED – IT IS NOT SUPPOSED TO BE THE WAY IT WAS PER THE RECOMMENDATION OF STATE DOT.  THE SHOULDERS WILL BE INSTALLED BY WASHINGTON COUNTY WITH A SHOULDER MACHINE WHEN IT CAN BE SCHEDULED.  PAUL ALSO ASKED WHY THERE IS A YIELD SIGN AT THE INTERSECTION INSTEAD OF A STOP SIGN.  GREG SAID THAT WHEN A TOWN ROAD INTERSECTS WITH A STATE ROAD – THE STATE CONTROLS THE TRAFFIC SIGNS.  THERE WAS DISCUSSION REGARDING THE INTENTION OF THE SECOND LANE ON STATE ROUTE 196.

 
PRINTING COSTS
TOWN CLERK, DENISE PETTEYS SAID THAT SHE INVESTIGATED THE PRICING FOR A DUPLICATE BOOK FOR ENFORCEMENT OFFICER.  SHE DID NOT HEAR FROM PRINTING PLUS BUT IN RESEARCHING – 2 PART RECEIPT BOOKS SHE ORDERED LAST YEAR COST $188.25 FOR 5 BOOKS.  COUNCILWOMAN BEECHER ASKED MARK IF HE FELT THAT THE CURRENT MOBILE HOME FORM SHOULD BE REVISED TO MEET THE CURRENT MOBILE HOME LAW.  MARK SAID, YES IT COULD BE REVISED WITH MORE INFORMATION.  JOHN HOLMES ASKED IF THEY COULD BE PRINTED BY THE COUNTY PRINTING OFFICE.  SUPERVISOR HAFF SAID THAT HE WAS NOT EVEN AWARE THAT THE COUNTY HAD A PRINTING OFFICE – HE WILL LOOK INTO IT.

 
THERE WAS DISCUSSION THAT THE YOUTH COMMISSION CAN PURCHASE PAPER TO PRINT FORMS.  IN THE PAST, YOUTH COMMISSION NEVER PROVIDED PAPER FOR COPIES MADE AT THE SCHOOL.

 
THERE WAS FURTHER DISCUSSION REGARDING THE HISTORY OF THE BILL KNAPP MOBILE HOME REQUIREMENTS.
